1. By entering the trade promotion, and in consideration of the opportunity to participate in the trade promtion, each entrant agrees to be bound by and observe these terms and conditions.
2. The promoter of the Trade promotion is Goldacres Trading P/L, Waringa Drive, Mitchell Park, Victoria 3355.
Who may enter.
1. Entry into the trade promotion is open to residents of Australia.
2. All paid employees of Goldacres Trading P/L and Polaris Sales Australia P/L, relatives of paid employees, and employees of any business that buys products from Goldacres Trading P/L and
Polaris Sales Australia P/L at wholesale prices are not eligible to enter the trade promotion.
How to enter.
1. To enter the trade promotion you must complete an entry on an original ticket obtained from Goldacres or Polaris Sales Australia P/L or as a clip-out ticket printed in major rural newspapers
periodically through the period of the promotion.
2. Photocopies will not be eligible for inclusion in the draw.
3. Entry is free.
4. All entry fields on the entry ticket deemed mandatory (i.e. name, address and phone number) must be completed for the entry into the trade promotion to be accepted.
5. Entrants must be aged 18 years or older.
Trade promotion Limitations and Period
1. Entry to the competition for Victorian residents will commence on the 26th September 2007.
2. Final entries by mail must be received at Goldacres, 9 Waringa Drive, Mitchell Park, VIC 3355 no later than 12 noon (AEST) on 18th September 2008.
3. Final entries in person can be lodged at the Goldacres stand ‘M’ at the Henty Machinery Field Days until 12 noon (AEST) on the 25th September 2008.
4. Entries not received within the Trade promotion Period or not completed in accordance with the Conditions of Entry will not be eligible to win.
Prizes and notification
1. One prize winner will be drawn on 25th September 2008 at 1.00 pm (AEST) by an official of the Henty Field Days committee, at the Goldacres trade stand at the Henty Field Days, Henty
NSW. The first trade promotion ticket drawn will win the prize.
2. The prizes are as follows: 1 X new Direct Chemical Injection unit complete with Raven Sidekick controller including installation and training at an authorised Goldacres dealer. (Transport of
the prize winners machine to the Dealership is the responsibility of the prize winner), value $11,211. 1 X new Goldacres SB100 12 volt sprayer, value $553. 1 X new Polaris model ‘X2 500
EFI’ ATV for farm use (unregistered), value $12,495. Total prize value $24,259.
3. Collection of the Polaris ATV with SB100 from Goldacres, 9 Waringa Drive, Mitchell Park, VIC, is the responsibility of the prize winner. The Direct Injection unit will be delivered to an
authorised Goldacres reseller within Australia, nearest as practicable to the prize winners address.
4. The prize winner will be notified by post within 2 weeks of the draw.
5. The name of the prize winner will be published in the next available issue after the draw, of The Weekly Times (VIC), The Land (NSW) and Farm Weekly (WA) newspapers, in the public notices section.
6. The prizes are not transferable or exchangeable.
7. The prizes are not redeemable for cash.
8. All prizes must be claimed within 3 months of the end of the trade promotion.
Information for Prize Winner
1. All entrants agree to provide Goldacres Trading P/L with identification and/or proof of age if selected as the prize winner or if reasonably requested by Goldacres Trading P/L. The form of
identification and/or proof of age as well as authorisation and release are at the discretion of Goldacres Trading P/L. Failure to provide such proof and authorisation will immediately invalidate
the prize winner’s entitlement to the prize, subject to state legislation.
2. The information entrants provide will be used by Goldacres Trading P/L and Polaris Sales Australia P/L for the purpose of conducting this promotion.
3. The prize winner agrees to the use of their name, image and photograph/s for publicity and promotion purposes, without compensation, and agree that Goldacres Trading P/L will own
copyright in any such images and photograph/s and in all material incorporating the photograph/s.
Limitation of Liability
1. No responsibility will be taken by Goldacres Trading P/L or its agents, officers or employees for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries
that are not genuine, are incomplete or late or are in any way fraudulent are void.
2. Neither Goldacres Trading P/L or its employees nor any other person or party associated with this promotion, will be liable for any loss or damage whatsoever suffered or personal injury
• suffered or sustained by an entrant:
• while driving any vehicle won as part of the Trade promotion; and/or
• as a consequence of late, lost or misdirected mail; and/or
• due to circumstances outside the Goldacres Trading P/L’s reasonable control.
3. If Goldacres Trading P/L is liable for any claim by the entrant, including a claim arising from the Promoters negligence, the Promoters liability for any such claim shall not exceed
AUD$1,000.00.
4. Goldacres Trading P/L is not liable for the cancellation of all or any part of the prizes, for any reason, subject to approval from the Victorian Commission for Gambling Regulation.
5. Goldacres Trading P/L reserves the right to change the prizes at any time if prizes become unavailable, subject to approval from the Victorian Commission for Gambling Regulation.
6. Goldacres Trading P/L reserves the right to cancel the trade promotion, subject to approval from the Victorian Commission for Gambling Regulation.
Privacy
1. Goldacres Trading P/L may disclose an entrant’s personal information to assist in conducting the trade promotion or communicating with an entrant. Entrants in the trade promotion
acknowledge that Goldacres Trading P/L may share an entrant’s personal information with the related entities of Goldacres Trading P/L which may contact you with information or promotions
regarding Goldacres Trading P/L and Polaris Sales Australia P/L. Entrants can access the personal information Goldacres Trading P/L holds about them by writing to Goldacres Trading P/L,
9 Waringa Drive, Mitchell Park, VIC.
2. By entering the promotion, each entrant agrees that Goldacres Trading P/L may disclose the entrant’s personal information to State and Territory gaming departments. The prize winner
acknowledges that their name will be published as required under the relevant gaming legislation and Goldacres Trading P/L may publish or cause to be published each prize winners name
and suburb in any media.
General
1. The trade promotion is a promotional opportunity and a ‘game of chance’. Each entrant, on completion of an entry ticket and successful completion of all mandatory fields on the entry ticket, is
entitled to an equal chance of winning the draw. All prizes remain the property of Goldacres Trading P/L until they are collected by selected prize winner. If for any reason the trade promotion is
not capable of running as planned, including causes beyond the control of Goldacres Trading P/L, which corrupt or affect the fairness or integrity or proper conduct of the trade promotion,
Goldacres Trading P/L reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the trade promotion.
2. Goldacres Trading P/L reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Goldacres Trading P/L, includes objectionable content, profanity,
potentially insulting, inflammatory or defamatory statements and disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms
and Conditions or who has, in the opinion of Goldacres Trading P/L, engaged in conduct in entering the trade promotion which is fraudulent, misleading, deceptive or generally damaging to
the goodwill or reputation of the trade promotion and/or Goldacres Trading P/L including but not limited to using techniques or methods to avoid payment of any costs. Goldacres Trading P/L
reserves the right to disqualify a prize winner if Goldacres Trading P/L becomes aware that the winner and/or the prize winners entry is of a type described in this paragraph.
3. Prize winners are advised that tax implications may arise from their prize winnings and should seek independent financial advice prior to their acceptance of their prize.
4. In the event that for any reason whatsoever a prize winner does not take an element of their prize at the time stipulated by Goldacres Trading P/L, then that element of the prize will be
forfeited by the prize winner and cash will not be awarded in lieu of that element of the prize.
